Will Haslun
Watercolor

In plain terms: Prints and other merchandise are sold through the Haslun Studio online shop, which is powered by Shopify. The shop handles checkout, payment, and shipping under its own store policies — I never see or store your card details. Original paintings are sold directly by inquiry. All sales are final, except for items that arrive damaged in transit. I don't sell or share your personal information. The full terms are below.

These Terms of Service ("Terms") govern your access to and use of the Haslun Studio website (the "Site") and your purchase of any artwork from the Artist. By accessing the Site or purchasing any artwork, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access the Site or purchase any artwork.

1. About Haslun Studio

Haslun Studio is operated by Will Haslun (the "Artist"), an independent artist based in New York City. The Site showcases original watercolor paintings and offers fine-art prints, including numbered limited editions and open editions. Prints and other merchandise are sold through a separate online shop hosted on Shopify; original paintings are sold directly by the Artist.

2. Purchases

(a) Prints and Merchandise (Online Shop). Prints and other merchandise are sold through the Haslun Studio online shop at https://shop.haslun.studio (the "Shop"), which is operated on the Shopify platform. All checkout, payment processing, order fulfillment, shipping, returns, and customer service for Shop orders are handled through the Shop and are governed by the Shop's own policies (including its Privacy, Refund, Shipping, and Terms of Service policies), which are presented to you at checkout. To the extent those policies conflict with these Terms with respect to a Shop order, the Shop's policies control for that order.

(b) Print Production. Prints are produced on demand by third-party fine-art printing labs. Limited edition prints are issued in a stated, capped quantity, are numbered, and are accompanied by a certificate of authenticity; once an edition sells out, no further prints in that edition are produced. Open edition prints are not numbered or capped.

(c) Original Works. Original paintings are sold by inquiry. Sales are confirmed via email, and payment is processed through Shopify or such other payment processor as the Artist may designate. All sales of original works are final.

(d) Payment Processing. The Artist does not store, process, or have access to your credit card numbers or payment account credentials. Payments are processed by Shopify and its payment providers, and are subject to their respective terms of service and privacy policies. By making a purchase, you authorize the applicable payment processor to charge your designated payment method for the full purchase price, including any applicable taxes and shipping costs.

(e) Damaged Items. If an original work or a print purchased directly from the Artist arrives damaged in transit, you must notify the Artist within seven (7) calendar days of delivery, with photographic evidence of the damage. The Artist will, at the Artist's sole discretion, either replace the item or issue a refund of the purchase price (excluding shipping costs). Returns, refunds, and damage claims for items purchased through the Shop are handled under the Shop's own policies.

(f) Authenticity and Marks. The Artist's signature ("HASLUN") identifies authorship, and the "WCH" monogram is the Studio's brand mark. The Artist's cinnabar seal is reserved for original paintings only and is hand-applied; it is never reproduced on prints or merchandise.

3. Intellectual Property

All artwork, images, and content on the Site and in the Shop are the intellectual property of Will Haslun / Haslun Studio. Purchasing a print or an original work grants you ownership of the physical work only, and does not grant any reproduction rights.

You may not reproduce, distribute, or create derivative works from any images without the Artist's written permission. Personal, non-commercial photography of works you own is permitted.

4. Website Use

(a) Lawful Use. You agree to use the Site for lawful purposes only. The Color Lab and other interactive tools are provided for educational and entertainment purposes.

(b) Availability. The Artist may modify, suspend, or discontinue any part of the Site or the Shop at any time, without notice or liability.

5. Privacy; Data Collection

(a) The Site. The Site itself does not require an account and does not process payments or collect payment information.

(b) Shop Purchases. When you purchase through the Shop, the information you provide (such as your name, contact details, shipping address, and payment information) is collected and processed by Shopify and its payment providers under their own privacy policies. The Artist receives only the order and shipping information necessary to fulfill your order, and never receives or stores your card numbers or payment credentials.

(c) Original Works and Correspondence. When you inquire about or purchase an original work directly, the Artist collects the information needed to respond and to fulfill the sale — typically your name, email address, and mailing address. This information is used solely for correspondence, fulfillment, and shipping, and is not sold, rented, or otherwise disclosed to any third party, except (i) as required by applicable law, or (ii) to shipping carriers for the purpose of delivering your order.

(d) Cookies and Analytics. The Site uses local browser storage for user preferences (such as dark mode). The Site does not use third-party tracking cookies or advertising networks.

(e) Your Requests. To correct or delete information the Artist holds directly, contact hello@haslun.studio. Information collected through the Shop is subject to Shopify's privacy policy and the data controls it provides.

6. Disclaimers; Limitation of Liability

(a) No Investment Advice. Nothing on the Site or in these Terms constitutes investment, financial, tax, or legal advice. Artwork is sold for aesthetic and collectible purposes and is not a regulated security or financial instrument. The Artist makes no representations or warranties regarding the appreciation, depreciation, or future value of any print or original work.

(b) As-Is Basis. THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

(c) Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE ARTIST OR HASLUN STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, ANY ARTWORK, OR ANY TRANSACTION CONTEMPLATED HEREBY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE ARTIST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. General Provisions

(a) Governing Law. These Terms, and any dispute arising out of or relating hereto or to any artwork, shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

(b) Jurisdiction; Venue. Each party hereby irrevocably submits to the exclusive jurisdiction of the state and federal courts located in New York County, New York, for the purpose of any action or proceeding arising out of or relating to these Terms, and irrevocably waives any objection it may now or hereafter have to the laying of venue in any such court and any claim that any such action or proceeding has been brought in an inconvenient forum.

(c) Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision hereof, and these Terms shall be construed as if such provision had never been contained herein.

(d) Waiver. No waiver of any provision of these Terms shall be effective unless in writing and signed by the party against whom such waiver is sought to be enforced. No failure or delay in exercising any right, power, or privilege hereunder shall operate as a waiver thereof.

(e) Assignment. The Artist may assign or transfer any or all of the Artist's rights and obligations under these Terms without the consent of any buyer. You may not assign or transfer any of your rights or obligations hereunder without the Artist's prior written consent.

(f) Entire Agreement. These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral, except that Shop orders are additionally governed by the Shop's own policies as described in Section 2(a).

(g) Amendment. The Artist reserves the right to amend these Terms at any time by posting the amended terms on the Site. Your continued use of the Site or purchase of any artwork after such posting constitutes acceptance of the amended Terms.

(h) Notices. All notices and other communications to the Artist shall be in writing and delivered by email to hello@haslun.studio, or by such other means as the Artist may designate. Notices to you may be sent to the email address associated with your inquiry or order.

(i) Headings. The headings in these Terms are for convenience of reference only and shall not affect the interpretation hereof.

(j) Survival. The provisions of Sections 3, 5, 6, and 7 shall survive any termination or expiration of these Terms or the sale of any artwork.
